The changement of the law about the VAT

The changement of the law about the VAT (valid from the 1st January 2013) changes the rules about the payments of the VAT. The domestic entrepreneur who provide the services to the foreign entrepreneur and the place of performance is in a foreign country is no longer the fully-fledged taxpayer and he becomes the so called identified person.

Before this changement, the entrepreneur became the taxpayer at the moment of the provision of the service.
The changement concerns the status of the domestic entrepreneur who is no longer the fully-fledged taxpayer, but he becomes so called indentified person.

The entrepreneurs become the persons extempted from taxes and they lose the rights to tax substractions. In practice that means that they will not list this tax in the accounts and they cannot demand its return at the end of the period.

The obligation of the identified person is to claim the tax return and the overall report according to the par. 102 about the VAT.

The domestic entrepreneurs who provide the services in the foreign country (member country of the EU) become the not fully-fledged taxpayers and they will obtain the DIČ (tax identification number).
